Class Cancellation Policy

Please understand that class space is limited. If you must cancel your reservation, we respectfully request that you cancel at least 12 hours before the start time of the class so that another customer has the opportunity to fill your spot. Missed classes, or classes cancelled within 12 hours, will incur a No-show fee of $10 for each missed class.

We require a credit card to hold your reservation. No-show fees will be charged to your card on file.

Privacy Policy

Handling of Personally identifiable Information (PII)

We at BYCI-SA, LP dba The Union, Fitness & Fun (The Union) are committed to protecting your privacy while providing you with the most enjoyable in-person online experience possible. We will not share, sell, trade, rent, or otherwise transmit any personally identifiable information with any unaffiliated individual or organization without your permission.

Registration and Collection of PII

We require registration and release of liability/indemnification to participate in activities at The Union. Registration includes collecting and storing PII in our computer systems, such as name, address, phone number, birthday, and email address. Your email address is also required to access registration and to book classes, purchase classes, packages, services and participate in online classes.

Social Media Activity

Some optional social media activities may require that you connect your account with The Union’s for purposes of social interaction and in some cases publicity and advertisement for us. If you do not consent to this activity, you are welcome to un-associate your account from ours at any time.

Unsubscribe and Opt-Out

At registration you have the option to receive periodic mailings from us with information on studio news, products, services and upcoming events. If you do not wish to receive these mailings, please let us know by either sending us an email at info@theunionsa.com or by clicking on the unsubscribe link at the bottom of any newsletter sent to you. Online Policies for Children (individuals under 18 years of age)

Our website, https://theunionsa.com, does not target children (persons under age 18) for collection of online information. We do not solicit or knowingly collect PII from children under the age of 18. No information should be submitted to or posted on our website or our social media platforms by users or visitors under 18 years of age. We do not knowingly interact online, through social media, or other online venues from users and customers under the age of 18 years of age.

Imagery, Photography, Video Release

By registering, purchasing classes or packages, or participating in any activity, you grant The Union, its representatives and employees the right to take photographs, videos, and audio recordings (recordings) of me or my property in connection with activities in which I participate.

You authorize The Union its assigns and transferees to copyright, use and publish the same in print and/or electronically. You agree that The Union may use such photographs and videos of me with or without my name and for any lawful purpose, including but not limited to such purposes as publicity, illustration, advertising, and web content. You hereby waive the right to receive any payments for use of any of the material recordings described above.

Intellectual Property

By registering, purchasing classes or packages, or participating in any activity at The Union, you understand that the materials provided to you within this program are the intellectual property of The Union. You agree not use, transfer, or reproduce any materials without the express written consent of The Union. You understand that the formats and techniques instructed at the Union are the express property of The Union. You agree not use, reproduce, or cause to be reproduced any classes, programs, workshops, brands, or other intellectual property for commercial or personal use without express written consent.

Notification of Changes

Any change to our privacy policy will be posted on our website, https://theunionsa.com, so you are always aware of what information we collect and how we use it.

Refund Policy

All of our class packages, pre-paid classes, workshops, series, programs, private classes, private parties, teacher trainings, deposits, travel excursions, and special events (hereafter collectively referred to as “events”) are non-refundable, non-extendable, non-sharable, and non-transferable to other people. All classes, packages and events have an activation date and expiration date. Please check your purchase receipt to verify your package and event dates.

All product purchases are non-returnable and non-refundable. Exchanges may be performed for items in a new and unused condition with all tags. All exchanges must have a valid receipt of purchase. No partial refunds or exchanges. No exchanges after 10 days from the date of sale.

Our classes and events can occasionally be canceled. In the event of cancellation, you will be notified by one of the communication preferences listed in your customer profile (see your profile online at https://clients.mindbodyonline.com/?studioid=1856). Please opt-in to all communication options so that you receive all news and notifications. In the rare event of a cancellation, we will withhold payments, or issue a refund, at our sole discretion. In the case of refund, money will be refunded to your customer account or to the payment method of the transaction. Refund method and amount will be at our sole discretion.

Our class schedules, teachers, events, and prices are subject to change without notice. Always check our website, https://theunionsa.com, for our most current information. Please opt-in to all communication options so that you receive all news and notifications.

All classes, packages, and events have a cancellation policy and are subject to cancellation fees. Absences and fees are non-refundable. See our Cancellation Policy for more details.

Terms and Conditions

GENERAL

By taking classes, purchasing products or services, or by participating in any activity at BYCI-SA, L.P. dba The Union, Fitness & Fun you agree to the following terms and conditions.

Come Early. Come often. Stay for the entire class

We start class on time. Arrive to class 15 minutes early. We want plenty of time for both you and your teacher to get you situated and prepared for an amazing experience. For good results come three times a week. For great results come 5 times a week and do a mix of studio and gym classes. Make a commitment to stay for the entire class.

Unplug in the Yoga Studio Space

When practicing in the studio, leave your phones and smart watches at home or in your car. Cellphones, smart watches, heartrate monitors and other personal electronics are not permitted in the class space. Connecting electronic device into The Union’s computers, devices, or wall outlets is prohibited.

Physical Security

We are not responsible for theft to your belongings on premise or in the parking lot. Please leave your valuables at home or secured in a safe place. Lockers are available at some locations. Secure your belongings with a lock and key if possible.

Photography

Photography in locker rooms, bathrooms, and changing areas is prohibited. Please do not bring or operate cameras and recording equipment on the premises without express permission from the studio manager, staff, or owners.

Equipment

Most specialized equipment will be provided for you. Your teacher or coach may ask you to assist in cleaning equipment that you’ve come in to contact with. We will provide you with cleaning materials as required. We ask that you purchase and bring items that touch your body like clothing, mats, towels, blocks, and/or water bottles. We have limited quantities of personal equipment for sale at the front desk and some items may run out of stock or be unavailable. Please come prepared for an amazing experience.

Secure your class booking

We ask that you secure your class bookings with a valid credit card, debit card, or ACH (payment method). A credit card is required to book class. A late fee may be assessed to the card on-file if class is canceled outside the cancellation window. Please refer to our Cancellation Policy for early- and late-cancellation policies. Our cancellation policy is displayed at checkout when booking classes online.

Unpaid classes

We will charge your credit card on file for any unpaid amounts for services, packages, and classes that you’ve taken at The Union. If we cannot charge your card on file, we will ask you to resolve any unpaid charges before we will permit you to take any more classes with us.

Right to Refuse Service

We reserve the right to refuse service to anyone.

Refunds

All products, services, and packages are non-refundable, non-transferable, and non-shareable. Please see our refund policy for full disclosure.

Prohibited Conduct

We will not tolerate verbal, physical or emotional abuse or harassment directed toward any customer or employee (hereafter Member). We will exercise our right to refuse service to anyone who violates prohibited conduct at the time of an incident and with respect to future membership.

Harassment by a Member of any person based on age, gender, gender identity, pronoun use, sexual orientation, race, ethnicity, culture, national origin, religion, body type, personal appearance, physical or mental ability, socioeconomic status, marital status, political activities or affiliation, or any other basis proscribed by local, state, provincial, national, and federal laws and regulations is strictly prohibited.

Harassment by a Member can be either in person or through online activities. Harassment is defined here as unwelcome verbal or non-verbal conduct where: (i) the conduct denigrates or shows hostility or aversion towards the person and has the purpose or effect of unreasonably interfering with their work, study, or other activity, (ii) enduring the offensive conduct becomes a condition of the continued relationship, and/or (iii) the conduct has the purpose or effect of creating an environment that a reasonable person would consider intimidating, hostile, or abusive.

Harassment includes epithets, slurs, name calling, negative stereotyping, insults, intimidation, ridicule, threatening, intimidating or hostile acts, denigrating jokes, and display of written or graphic material that denigrates or shows hostility or aversion toward an individual or group based on their protected characteristic.

Harassment includes, but is not limited to: offensive verbal comments related to age, gender, gender identity, pronoun use, sexual orientation, race, ethnicity, culture, national origin, religion, body type, personal appearance, physical or mental ability, socioeconomic status, marital status, political activities or affiliation, or any other basis proscribed by local, state, provincial, national, and federal laws and regulations; deliberate intimidation; stalking; following; harassing photography or recording; sustained and intentional disruption of class or other events; and inappropriate physical contact or unknown, such as trolling, stalking, using hate speech, threatening, intimidating, falsely accusing, reporting of false grievances, manipulating, or otherwise harassing in any form or manner.

Sexual harassment and/or misconduct by a member of any person is strictly prohibited. Sexual harassment is unwelcomed conduct of a sexual nature, whether physical or verbal in nature. Non-consensual sexual touching: a broad term that refers to any deliberate non-consensual touching of a person’s body, which conduct can range from unwanted touching, such as fondling, up to, and including, non-consensual sex. Verbal: the use of sexually suggestive or explicit statements, whether through speech or written form, that create a hostile environment. While it is not possible to list all of the circumstances that may constitute sexual misconduct, the following are some examples of conduct, which, if unwelcome, may constitute sexual misconduct: Unwelcome sexual advances, whether they involve physical touching or not; Sexual epithets, jokes, written or verbal references to sexual conduct, gossip regarding one’s sex life, commentary on an individual’s body, commentary about an individual’s sexual activity, deficiencies, or prowess; Displays of sexually suggestive objects, pictures, or cartoons; Unwelcome leering, whistling, brushing against the body, sexual gestures, or suggestive or insulting comments; Comments or conjecture about a person’s sexual orientation or gender identity; Inquiries into one’s sexual experiences; and/or discussion of one’s sexual activities.

Retaliation by a Member against any persons who report any instances of harassment is strictly prohibited. Retaliation is any adverse action or threat taken or made against an individual, including through third parties and/or legal counsel, for making a report of prohibited conduct or participating in any investigation or proceeding related to this Policy. Retaliation includes threatening, intimidating, harassing, or any other conduct that would discourage a reasonable person from engaging in activity protected under this Policy. Retaliation also includes maliciously and/or intentionally interfering with, threatening, or harming the academic or professional career or reputation of another individual before, during, or after the Investigation, Decision, and resolution of a report of prohibited conduct under this Policy in response to and/or on account of the report of the prohibited conduct. This provision applies to reports made or information provided in good faith, even if the facts alleged in the report are determined not to be accurate.

Non-discrimination Statement and Policy

The Union does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers and vendors, and provision of services.
